STONE Performance Training Terms & Conditions

Last Updated: 4/25/26
Business Location: 730 17th Bakersfield, California 93301
Website: stonedojo.com

Welcome to STONE Performance Training. By using our website, registering for a membership, attending a class, participating in training, booking a session, or using our facility, you agree to the following Terms & Conditions.

These Terms apply to all members, clients, guests, parents/guardians of youth participants, and visitors of STONE Performance Training.

1. About STONE Performance Training

STONE Performance Training provides fitness training, boxing fitness, no-contact boxing, athletic performance training, small group training, private coaching, open gym access, youth training, adult training, workshops, and related performance-based services.

Our programs are designed to support physical fitness, discipline, confidence, skill development, and overall performance. Services may vary based on coach availability, program offerings, class schedules, membership type, and facility capacity.

2. Eligibility to Participate

Participants must be physically and mentally able to safely engage in fitness, boxing, conditioning, strength training, or related activities.

Youth participants under the age of 18 must have parent or legal guardian consent before participating. STONE Performance Training reserves the right to determine whether a youth participant is appropriate for a specific class, program, or training environment based on age, maturity, safety, skill level, and coach approval.

STONE may refuse or limit participation if a participant’s behavior, condition, skill level, or conduct presents a safety concern.

3. Health, Safety, and Medical Responsibility

Participation in fitness and boxing-related activities involves physical exertion and potential risk. By participating, you confirm that you are voluntarily choosing to engage in physical activity and that you are responsible for determining whether participation is appropriate for your health.

Participants are encouraged to consult with a physician or qualified healthcare provider before beginning any fitness, boxing, strength, conditioning, or athletic program, especially if they have a medical condition, injury, disability, heart condition, pregnancy, or other health concern.

STONE Performance Training does not provide medical advice, diagnosis, treatment, or physical therapy unless specifically provided by a licensed professional operating within their scope of practice.

4. Assumption of Risk

By participating in STONE Performance Training activities, you understand and accept that fitness training, boxing training, strength training, conditioning, athletic movement, and gym use involve inherent risks.

These risks may include, but are not limited to, muscle soreness, fatigue, sprains, strains, bruises, falls, equipment-related injuries, accidental contact, overexertion, dehydration, and other physical injuries.

You agree to participate at your own risk and to follow all coach instructions, safety rules, posted guidelines, and facility policies.

5. Waiver and Release of Liability

To the fullest extent permitted by California law, you agree to release, waive, and hold harmless STONE Performance Training, its owners, coaches, contractors, staff, representatives, affiliates, and facility partners from claims, demands, damages, injuries, or losses arising from your participation in training, classes, gym use, programs, events, or related activities.

This waiver is intended to apply to ordinary risks associated with recreational fitness and training activities. It does not waive liability for conduct that cannot legally be waived under California law, including gross negligence, recklessness, intentional misconduct, or violations of law.

6. Memberships, Programs, and Payments

Memberships, programs, training packages, classes, assessments, and special events may have separate pricing, terms, and conditions.

Payment is due according to the membership, package, invoice, or program agreement selected. Failure to make timely payment may result in suspension of access, cancellation of sessions, removal from classes, or termination of membership.

Prices are subject to change. Any pricing changes will be communicated before they apply to future billing periods, renewals, or new purchases.

7. Recurring Billing and Auto-Renewal

Some memberships or programs may be billed on a recurring basis. By enrolling in a recurring membership, you authorize STONE Performance Training or its payment processor to charge your selected payment method according to the agreed billing schedule.

Recurring billing terms, renewal terms, and cancellation options will be disclosed at the time of sign-up. California and federal regulators have increased focus on clear subscription cancellation and recurring billing practices, including gym memberships, so recurring terms should be clear, easy to understand, and easy for clients to cancel.

8. Cancellation Policy

Clients and members are expected to provide at least 24 hours’ notice when canceling or rescheduling a private session, assessment, class reservation, or appointment.

Cancellations made with less than 24 hours’ notice may be considered a late cancellation and may result in the session being charged, forfeited, or counted as used.

No-shows may result in the session being charged or forfeited. Repeated late cancellations or no-shows may impact future booking privileges.

Emergency situations may be reviewed on a case-by-case basis.

9. Membership Cancellation

Membership cancellation procedures may depend on the type of membership or program selected.

To cancel a membership, members must contact STONE Performance Training through the approved cancellation method provided at sign-up or by contacting STONE directly.

Cancellation requests must be submitted before the next billing cycle to avoid future charges. Fees already paid may not be refundable unless otherwise stated in writing or required by law.

10. Refund Policy

Payments for memberships, training packages, assessments, classes, programs, and events are generally non-refundable once purchased, unless otherwise stated in writing.

STONE may, at its discretion, offer account credit, rescheduling, or transfer options in limited circumstances.

Refunds are not guaranteed for missed sessions, unused open gym access, late cancellations, no-shows, failure to attend, or personal scheduling conflicts.

11. Open Gym Access

Open gym access is available to members based on membership type and facility rules.

Standard member access may be available from 6:00 AM to 9:00 PM. Certain memberships may include 24-hour access, subject to approval, membership type, security requirements, and facility guidelines.

Members using the facility during open gym or 24-hour access are responsible for training safely, respecting the space, cleaning up after themselves, and following all posted rules.

STONE reserves the right to revoke open gym or 24-hour access for misuse, unsafe behavior, policy violations, unpaid balances, or conduct concerns.

12. No-Contact Boxing Policy

STONE Performance Training offers no-contact boxing options for individuals who want to train boxing technique, conditioning, skill development, and fitness without sparring or physical contact.

No participant is required to spar or participate in contact drills. Any contact-based training, sparring, or advanced boxing work must be approved by a coach and based on readiness, safety, experience, consent, and facility rules.

13. Beginner Level Policy

Beginners are welcome at STONE Performance Training. Participants are not expected to have prior boxing, fitness, or athletic experience.

Coaches may modify training, drills, exercises, or class participation based on skill level, conditioning, safety, and readiness. Beginners may be required to focus on fundamentals before progressing into advanced drills, higher intensity training, or contact-based activities.

14. Code of Conduct

All members, clients, guests, and participants are expected to treat coaches, staff, other members, and the facility with respect.

The following conduct is not allowed:

  • Harassment, bullying, threats, intimidation, or discrimination
  • Unsafe use of equipment
  • Fighting, aggressive behavior, or unauthorized sparring
  • Disrespect toward coaches, staff, or members
  • Theft, vandalism, or damage to property
  • Training under the influence of drugs or alcohol
  • Ignoring coach instructions or safety rules
  • Misuse of 24-hour access or facility entry systems

STONE reserves the right to remove any person from the facility, suspend membership, or terminate services for conduct that violates these Terms or creates a safety concern.

15. Facility Rules and Equipment Use

Participants must use equipment properly and follow coach instructions. Members are expected to clean equipment after use, return equipment to its proper place, avoid damaging property, and report broken or unsafe equipment immediately.

Members are responsible for personal belongings. STONE Performance Training is not responsible for lost, stolen, or damaged personal items.

16. Photos, Videos, and Media

STONE Performance Training may take photos or videos during classes, events, training sessions, or facility activities for marketing, educational, or promotional purposes.

By participating, you understand that media may be captured in a public training environment. If you do not want to be photographed or recorded, please notify STONE staff in writing.

Youth participants require parent or guardian permission before being featured in promotional media.

20. Privacy

STONE respects the privacy of members, clients, and website visitors. Personal information submitted through the website, forms, scheduling platforms, or payment systems may be used to communicate with you, manage services, process payments, and operate the business.

Health, fitness, and program information should only be submitted through approved channels. For details, users should review STONE’s Privacy Policy.

21. Service Changes and Facility Availability

STONE reserves the right to modify, pause, cancel, or discontinue classes, programs, memberships, open gym hours, events, or services at any time based on facility needs, staffing, safety concerns, holidays, repairs, emergencies, demand, or business operations.

STONE will make reasonable efforts to communicate significant changes to affected members or clients.

22. Termination of Membership or Access

STONE Performance Training reserves the right to suspend or terminate a membership, training package, class participation, open gym access, or facility access for any violation of these Terms, unsafe behavior, unpaid balances, misconduct, or any behavior that negatively impacts the safety or experience of others.

Termination may occur with or without refund depending on the circumstances and applicable law.

23. Governing Law

These Terms & Conditions are governed by the laws of the State of California. Any disputes related to these Terms, STONE Performance Training, website use, memberships, or services shall be handled in accordance with applicable California law.

24. Updates to These Terms
